The author attempted to present the development of legal theories through early & medieval philosophical history.

Here I examine Bernard Suits’s definition of games and explain why that definition is in need of reference to representation or, put more generally, to semiosis. And, once admitting the necessity of the representational in games, Suits’s definition must also then admit the essential paradoxy of games.

Imagination plays a rich epistemic role in our cognitive lives. For example, if I want to learn whether my luggage will fit into the overhead compartment on a plane, I might imagine trying to fit it into the overhead compartment and form a justified belief on the basis of this imagining. But what explains the fact that imagination has the power to justify beliefs, and what is the structure of imaginative justification? In this paper, I answer these questions by arguing (...) that imaginings manifest an epistemic status: they are epistemically evaluable as justified or unjustified. This epistemic status grounds their ability to justify beliefs, and they accrue this status in virtue of being based on evidence. Thus, imaginings are best understood as justified justifiers. I argue for this view by way of showing how it offers a satisfying explanation of certain key features of imaginative justification that would otherwise be puzzling. I also argue that imaginings exhibit a number of markers of the basing relation, which further motivates the view that imaginings can be based on evidence. The arguments in this paper have theoretically fruitful implications not only for the epistemology of imagination, but for accounts of reasoning and epistemic normativity more generally. (shrink)

Today, any credible philosophical attempt to discuss personhood must take some position on the proper relation between the philosophical analysis of topics like action, intention, emotion, normative and evaluate judgment, desire and mood --which are grouped together under the heading of `moral psychology'-- and the usually quite different approaches to ostensibly the same phenomena in contemporary theoretical psychology and psychoanalytic practice. The gulf between these two domains is so deep that influential work in each takes no direct account of developments (...) in the other. I believe that there is much to be learned about dominant and often hidden assumptions in contemporary approaches to personhood by comparisons between these fields, but at the outset I want to distinguish this intuition from another one in vogue among philosophers working to bridge the gap between philosophical and psychological disciplines today. This is the somewhat positivist sense that philsophical investigation must take its starting-points and limits from well-established psychological findings, and that philosophical accounts at odds with these are for that reason unrealistic, or obviously trading on outmoded and scientifically discredited `folk metaphysics.' For example, this sense that philosophy must acknowledge its secondary position relative to empirical psychology is implicit throughout Bernard Williams's work on motivation and morality, and it is the explicit basis of Owen Flanagan's recent attempt to limit ethical theory by `psychological realism' and argue for a form of relativism by "[a]ttention to psychological facts." Because all modern conceptions of morality are committed to making "our motivational structure, our personal possibilities, relevant in setting their moral sights," they cannot be developed without. This chapter argues that epistemic uses of the imagination are a sui generis form of reasoning. The argument proceeds in two steps. First, there are imaginings which instantiate the epistemic structure of reasoning. Second, reasoning with imagination is not reducible to reasoning with doxastic states. Thus, the epistemic role of the imagination is that it is a distinctive way of reasoning out what follows from our prior evidence. This view has a number of important implications for the epistemology of the (...) imagination. For one thing, it clarifies the epistemic role of widely invoked “constraints” on the imagination. For another, it highlights important and underappreciated disanalogies between how perceptual experiences and imaginings justify beliefs. Ultimately, the view that we can reason with imagination offers an illuminating and theoretically fruitful framework through which to understand the epistemic structure of the imagination. (shrink)

Recently, commentators close to and within the UK government have claimed that patient choice can increase equity in the context of the National Health Service. This article critically examines the basis for this claim through analysis of recent speeches and publications authored by secretaries of state for health and their policy advisers. It is concluded that this claim has not developed prospectively from an analysis of the causes of healthcare inequity, or even with a consistent normative definition of equity. The Dutch philosopher of religion Hent de Vries has explored and complicated the boundaries between religion and modern thought in order to create the space for an innovative “minimal theology.” This article reconstructs de Vries's interpretation of the changes in Theodor W. Adorno's thought between Dialectic of Enlightenment and Negative Dialectics in order to demonstrate its fecundity for a philosophical account of otherness. It also examines and defends de Vries's own rhetorical mode of reading texts as an exemplary approach to (...) philosophical dialogue. Finally, however, the essay challenges de Vries's privileging of the religious as the site of ethical relationality and his intentional bracketing of Adorno's critical social theory. (shrink)

Moral Reasoning In an effort to reduce the cost of education for students, this textbook was funded by over 700 people through the Kickstarter online crowd-funding platform.

In the mid twentieth century the philosopher Ludwig Wittgenstein famously asserted that games are indefinable; there are no common threads that link them all. "Nonsense," says the sensible Bernard Suits: "playing a game is a voluntary attempt to overcome unnecessary obstacles." The short book Suits wrote demonstrating precisely that is as playful as it is insightful, as stimulating as it is delightful. Suits not only argues that games can be meaningfully defined; he also suggests that playing games is a (...) central part of the ideal of human existence, so games belong at the heart of any vision of Utopia. Originally published in 1978, The Grasshopper is now re-issued with a new introduction by Thomas Hurka and with additional material (much of it previously unpublished) by the author, in which he expands on the ideas put forward in The Grasshopper and answers some questions that have been raised by critics. This paper develops a theory of analog representation. We first argue that the mark of the analog is to be found in the nature of a representational system’s interpretation function, rather than in its vehicles or contents alone. We then develop the rulebound structure theory of analog representation, according to which analog systems are those that use interpretive rules to map syntactic structural features onto semantic structural features. The theory involves three degree-theoretic measures that capture three independent ways in which (...) a system can be more or less analog. We explain how our theory improves upon prior accounts of analog representation, provides plausible diagnoses for novel challenge cases, extends to hybrid systems that are partially analog and partially symbolic, and accounts for some of the advantages and disadvantages of representing analogically versus symbolically. In his prose writings, Milton produces a reinvention of the concept of heresy, and subsequently a theological reinvention of the nature of English society. He envisions a Protestant society united by practices of individual piety and by the “heretical imperative” of autonomous choice. While Milton’s account seeks to eliminate the possibilities of religious violence and state persecution, it leads finally to the same impasse as the Lockean theory: the grounding of a right to toleration on subjective piety necessarily excludes those (...) groups who refuse to practice such piety. Nevertheless, Milton’s unique depiction of a society united by practices of heresy ultimately points toward modernity in a way that is even more remarkably prescient than Locke’s influential theory of toleration. We tend to suppose that the ancient Greeks had primitive ideas of the self, of responsibility, freedom, and shame, and that now humanity has advanced from these to a more refined moral consciousness. Bernard Williams's original and radical book questions this picture of Western history. While we are in many ways different from the Greeks, Williams claims that the differences are not to be traced to a shift in these basic conceptions of ethical life. We are more like the (...) ancients than we are prepared to acknowledge, and only when this is understood can we properly grasp our most important differences from them, such as our rejection of slavery. The author is a philosopher, but much of his book is directed to writers such as Homer and the tragedians, whom he discusses as poets and not just as materials for philosophy. At the center of his study is the question of how we can understand Greek tragedy at all, when its world is so far from ours. Williams explains how it is that when the ancients speak, they do not merely tell us about themselves, but about ourselves. _Shame and Necessity_ gives a new account of our relations to the Greeks, and helps us to see what ethical ideas we need in order to live in the modern world. ABSTRACT The primary aim of the paper is to apply the concept of retribution to nuclear defence policy. Nuclear defence policy, as I conceive it, is concerned with addressing the threat Soviet nuclear weapons pose for Western security. I argue that, contrary to popular opinion, MAD is not a retributive doctrine—that in fact it violates two constitutive principles of retribution: culpability and proportionality. After explicating these constitutive principles, I apply them to retaliatory strategy—showing that the culpability criterion restricts retaliation to (...) the agents of aggression while the proportionality criterion requires a just measure of retaliation. The result is a defence policy continuous with the just war tradition—one which rules out deterrence based on threats against the civilian population. I show why a retributive policy requires non‐nuclear forces and discuss the feasiblity of replacing all nuclear forces with conventional weapons. I anticipate and answer major objections to the denuclearization of U.S. and NATO forces. Finally, I conclude that an advocate of a retributive policy—specifically, a policy calling for a proportional or measured response against combatants only—must be willing, in the name of justice, to accept the risk of making war more thinkable by making it less horrible. Background Despite the growth of biomedical research in South Africa, there are few insights into the operation of Research Ethics Committees (RECs) in this setting. We investigated the composition, operations and training needs of health RECs in South Africa against the backdrop of national and international guidelines. Methods The 12 major health RECs in South Africa were surveyed using semi-structured questionnaires that investigated the composition and functions of each REC as well as the operational issues facing committees. Results Health RECs (...) in SA have an average of 16 members and REC members are predominantly male and white. Overall, there was a large discrepancy in findings between under-resourced RECs and well resourced RECs. The majority of members (56%) are scientists or clinicians who are typically affiliated to the same institution as the health REC. Community representatives account for only 8% of membership. Training needs for health REC members varied widely. Conclusion Most major health RECs in South Africa are well organized given the resource constraints that exist in relation to research ethics in developing countries. However, the gender, racial and occupational diversity of most of these RECs is suboptimal, and most RECs are not constituted in accordance with South African guidelines. Variability in the operations and training needs of RECs is a reflection of apartheid-entrenched influences in tertiary education in SA. While legislation now exists to enforce standardization of research ethics review systems, no provision has been made for resources or capacity development, especially to support historically-disadvantaged institutions. Perpetuation of this legacy of apartheid represents a violation of the principles of justice and equity. (shrink)

It used to be that everyone read the "notorious" Bernard Mandeville (1670-1733). He was a great satirist and come to have a profound impact on economics, ethics and social philosophy. This book offers the fullest and most sophisticated account of Gert's influential moral theory, a model first articulated in the classic work The Moral Rules: A New Rational Foundation for Morality, published in 1970. In this final revision, Gert makes clear that the moral rules are only one part of an informal system that does not provide unique answers to every moral question but does always provide a range of morally acceptable options. A new chapter on reasons includes an account (...) of what makes one reason better than another and a second new chapter is devoted to the question of justifying violations of the rules. This book deals with nonseparability, hidden variable theories, measurement theories and several related problems. Mathematical arguments are presented with an emphasis on simple but adequately representative cases. The conclusion incorporates a description of a set of relationships and concepts that could compose a legitimate view of the world.

Die "Paradoxien des Unendlichen" sind ein Klassiker der Philosophie der Mathematik und zugleich eine gute Einführung in das Denken des "Urgroßvaters" der analytischen Philosophie. Das Unendliche - seit jeher ein Faszinosum für die philosophische Reflexion - wurde in der Zeit nach der Grundlegung der Analysis durch Leibniz und Newton in der Mathematik zunächst als Problem betrachtet, das sich nicht vollkommen widerspruchsfrei behandeln lässt. Bernard Bolzano, der heute als "Urgroßvater der analytischen Philosophie" (Michael Dummett) gilt, zeigt in diesem klassisch gewordenen (...) Text jedoch, dass es beim Nachdenken über das Unendliche, sofern man begrifflich differenziert argumentiert und klare Definitionen zugrunde legt, keine echten Widersprüche gibt und sich die "Paradoxien des Unendlichen" auflösen lassen. Bolzano setzt sich zunächst mit den Unendlichkeitsbegriffen der Mathematik und der (idealistisch geprägten) Philosophie seiner Zeit auseinander, bevor er sich Schritt für Schritt die analytischen Grundlagen einer konsistenten Theorie des Unendlichen erarbeitet. Bereits einige Jahrzehnte vor Georg Cantors bis heute maßgeblicher mathematischer Unendlichkeitsdefinition gelingt Bolzano mit diesem Werk, dessen logische Klarheit und dessen Grad an philosophischer Durchdachtheit bis heute Beispielcharakter haben, die Rehabilitation des Unendlichen für die Philosophie der Mathematik. This volume is a revised, enlarged, and broadened version of Gert's classic 1970 book, The Moral Rules. Advocating an approach he terms "morality as impartial rationality," Gert here presents a full discussion of his moral theory, adding a wealth of new illuminating detail to his analysis of the concepts--rationality/irrationality, good/evil, and impartiality--by which he defines morality. He constructs a "moral system" that includes rules prohibiting the kinds of actions that cause evil, procedures for determining when violation of the rules is (...) permitted, and ideals which encourage actions that prevent or relieve suffering. To be valid, Gert argues, any such system must be "a public system that applies to all rational persons." The book concludes with a discussion of medical ethics, demonstrating the link between moral theory and its application to real moral problems. (shrink)

This paper explores a remarkable convergence of ideas and evidence, previously presented in separate places by its authors. That convergence has now become so persuasive that we believe we are working within substantially the same broad framework. Taylor's mathematical papers on neuronal systems involved in consciousness dovetail well with work by Newman and Baars on the thalamocortical system, suggesting a brain mechanism much like the global workspace architecture developed by Baars (see references below). This architecture is relational, in the sense (...) that it continuously mediates the interaction of input with memory. While our approaches overlap in a number of ways, each of us tends to focus on different areas of detail. What is most striking, and we believe significant, is the extent of consensus, which we believe to be consistent with other contemporary approaches by Weiskrantz, Gray, Crick and Koch, Edelman, Gazzaniga, Newell and colleagues, Posner, Baddeley, and a number of others. We suggest that cognitive neuroscience is moving toward a shared understanding of consciousness in the brain. (shrink)

Conscious experience is one of the most difficult and thorny problems in psychological science. Its study has been neglected for many years, either because it was thought to be too difficult, or because the relevant evidence was thought to be poor. Bernard Baars suggests a way to specify empirical constraints on a theory of consciousness by contrasting well-established conscious phenomena - such as stimulus representations known to be attended, perceptual, and informative - with closely comparable unconscious ones - such (...) as stimulus representations known to be preperceptual, unattended, or habituated. Adducing data to show that consciousness is associated with a kind of global workplace in the nervous system, and that several brain structures are known to behave in accordance with his theory, Baars helps to clarify many difficult problems.
